The Centre has said that transfer of Patna FIR to the CBI in the case makes it “a necessary and proper party” to Rhea’s plea pending in the apex court.
The plea has been filed through the DoPT under secretary Satya Prakash Ram Tripathi.
The Centre had earlier informed the top court that it has accepted the recommendation of Bihar government for CBI probe into the FIR lodged at Patna by Krishna Kishor Singh, father of Rajput, accusing Rhea and six others of various offences including abetment of suicide.
The Supreme Court is expected to hear Rhea’s plea next week.
Until then, the Supreme Court has directed all parties to file their replies and Mumbai Police is directed to place the report of investigations, he added.
According to Rhea’s lawyer, unless the Maharashtra Government consents to the CBI investigating the case “it would be totally illegal and beyond any known legal principles, affecting the Federal Structure of the Nation,” he said.
The Special Investigation Team (SIT) of the CBI that is probing this case had previously worked on several high profile cases including that of Vijay Mallya.
Sushant was found dead in his Bandra apartment on June 14. The actor’s death was reportedly registered as a suicide, and the post mortem reports ruled out any signs of foul play.
